Terms of Service

These Terms of Service (“Terms”) govern your access to and use of LocationFlow, a booking and business-management platform operated by BenJamin Morin, a sole proprietor doing business as Awesomeosity (“LocationFlow,” “we,” “us”). By creating an account or using the service, you agree to these Terms.

The service

LocationFlow provides online booking with drive-time-aware scheduling, a hosted branded website per business, client messaging, deposits and reminders, and related tools. We may add, change, or remove features over time.

Accounts & eligibility

• You must be at least 18 and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity under your account.

Provider responsibilities

If you use LocationFlow to run a business (a “Provider”), you are responsible for your relationship with your clients, the services you deliver, your lawful collection and use of client information, and compliance with applicable laws (including consumer-protection, tax, and messaging-consent rules). You are the controller of your clients’ data; we process it on your behalf to provide the service.

Acceptable use

You agree not to:

• use the service for unlawful, harmful, deceptive, or infringing purposes;
• send messages without the recipient’s required consent;
• attempt to breach security, access other tenants’ data, or disrupt the service;
• reverse-engineer or resell the service except as expressly permitted.

Third-party services

The service integrates with third parties such as Google (Calendar), payment processors (Stripe, Square), and mapping providers. Your use of those integrations is also subject to the third party’s terms, and we are not responsible for their services. Connecting a Google account is governed by our Privacy Policy.

Fees & payments

Paid plans, trials, and any per-transaction fees are described at sign-up or in your account. Fees are billed in advance and are non-refundable except where required by law. Payment processing is handled by our processors; amounts your clients pay you flow through your own connected processor account where applicable.

Intellectual property

LocationFlow and its software, design, and content are owned by BenJamin Morin (doing business as Awesomeosity) and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service. You retain ownership of the content you upload; you grant us the rights needed to host and display it to operate the service.

Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that scheduling, drive-time estimates, or reminders will be accurate in every case.

Limitation of liability

To the maximum extent permitted by law, LocationFlow and Awesomeosity will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify and hold harmless LocationFlow and Awesomeosity from claims arising out of your use of the service, your content, your services to your clients, or your violation of these Terms or applicable law.

Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or to protect the service. On termination, your right to use the service ends; we may delete your data after a reasonable period, subject to our Privacy Policy and legal obligations.

Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas, unless otherwise required by law.

Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date; continued use after changes means you accept them.
